ChordCrack Terms of Service

1. Agreement to Terms

By downloading, installing, accessing, or using ChordCrack ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the App.

2. Description of Service

ChordCrack is a mobile application designed to help users learn and practice guitar chord recognition through interactive games, exercises, and progress tracking features.

3. User Accounts

3.1 Account Creation

• You must provide accurate, current, and complete information during registration
• You must be at least 13 years of age to create an account
• You are responsible for safeguarding your account credentials
• You agree to notify us immediately of any unauthorized use of your account

3.2 Account Security

• Choose a strong, unique password for your account
• Do not share your account credentials with others
• You are fully responsible for all activities that occur under your account
• We are not liable for any loss or damage from your failure to secure your account

4. Acceptable Use

4.1 Permitted Uses

• Use the App for personal, non-commercial purposes
• Create and share content related to guitar learning within the App's community features
• Participate respectfully in any social features or leaderboards

4.2 Prohibited Activities

You agree NOT to:

• Reverse engineer, decompile, or attempt to extract source code from the App
• Use automated bots, scripts, or tools to interact with the App
• Upload or share inappropriate, offensive, or copyrighted content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the App's functionality or servers
• Use the App for any illegal or unauthorized purpose
• Harass, bully, or harm other users

5. Intellectual Property Rights

5.1 Our Content

• ChordCrack and all its content, features, and functionality are owned by us
• This includes but is not limited to: software code, audio files, graphics, user interface, and design
• You may not copy, modify, distribute, sell, or lease any part of our services

5.2 User Content

• You retain ownership of any content you create using the App
• By using the App, you grant us a limited license to use your content for providing and improving our services
• You are responsible for ensuring your content does not violate others' rights

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

7. In-App Purchases and Subscriptions

• All purchases are processed through your device's app store (Apple App Store or Google Play Store)
• All sales are final unless otherwise required by law
• Subscription fees are charged in advance and will automatically renew unless cancelled
• You can manage subscriptions through your device's app store settings
• Refund policies are governed by the respective app store's terms

8. Service Availability and Modifications

• We strive to provide reliable service but cannot guarantee 100% uptime
• We may modify, suspend, or discontinue any aspect of the App at any time with reasonable notice
• We may update the App to add features, fix bugs, or improve performance
• Some features may require the latest version of the App

9. Disclaimers and Limitations of Liability

9.1 Disclaimers

• The App is provided "as is" and "as available" without any warranties
• We do not guarantee that the App will be error-free or uninterrupted
• We are not responsible for any content created by users

9.2 Limitation of Liability

• Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim
• We are not liable for indirect, incidental, special, or consequential damages
• Some jurisdictions do not allow these limitations, so they may not apply to you

10. Account Termination

10.1 Termination by You

• You may delete your account at any time through the App's account settings
• Upon account deletion, your data will be permanently removed within 30 days

10.2 Termination by Us

• We may suspend or terminate your account for violations of these Terms
• We will provide reasonable notice when possible
• Serious violations may result in immediate termination

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

11.2 Dispute Process

1. Informal Resolution: Contact us first at support@chordcrack.com
2. Mediation: If informal resolution fails, disputes will be resolved through mediation
3. Arbitration: Remaining disputes will be resolved through binding arbitration

12. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes through the App or email. Continued use after changes constitutes acceptance of the modified Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the complete agreement between you and ChordCrack regarding the use of the App.
